【Simple Color Match-3】利用規約 日本語版

この利用規約（以下，「本規約」といいます。）は，私Bishatora（以下，「私」といいます。）が本ゲームアプリで提供するゲーム（以下，「本アプリ」といいます。）の利用条件を定めるものです。プレイするユーザーの皆さま（以下，「ユーザー」といいます。）には，本規約に従って，本サービスをご利用いただきます。

第1条（適用）

  1. 本規約は，ユーザーと私との間の本アプリの利用に関わる一切の関係に適用されるものとします。
  2. ユーザーが本アプリを情報端末にダウンロードし、利用を開始した場合、本規約に同意したものとみなします。
  3. 私は本アプリに関し，本規約のほか，ご利用にあたってのルール等，各種の定め（以下，「個別規定」といいます。）をすることがあります。これら個別規定はその名称のいかんに関わらず，本規約の一部を構成するものとします。
  4. 本規約の規定が前条の個別規定の規定と矛盾する場合には，個別規定において特段の定めなき限り，個別規定の規定が優先されるものとします。

第2条（広告）

広告（Google AdMob）が表示されることがあります。

第3条（禁止事項）

  1. 法令または公序良俗に違反する行為
  2. 犯罪行為に関連する行為
  3. 本アプリの内容等，本アプリに含まれる著作権，商標権ほか知的財産権を侵害する行為
  4. 私，ほかのユーザー，またはその他第三者のサーバーまたはネットワークの機能を破壊したり，妨害したりする行為
  5. 本アプリによって得られた情報を商業的に利用する行為
  6. 私のアプリの運営を妨害するおそれのある行為
  7. 不正アクセスをし，またはこれを試みる行為
  8. 他のユーザーに関する個人情報等を収集または蓄積する行為
  9. 不正な目的を持って本アプリを利用する行為
  10. 私のアプリに関連して，反社会的勢力に対して直接または間接に利益を供与する行為
  11. その他，私が不適切と判断する行為

第4条（本アプリの提供の停止等）

  1. 私は，以下のいずれかの事由があると判断した場合，ユーザーに事前に通知することなく本アプリの全部または一部の提供を停止または中断することができるものとします。
    1. 本アプリの更新を行う場合
    2. 地震，落雷，火災，停電または天災などの不可抗力により，本アプリの提供が困難となった場合
    3. コンピュータまたは通信回線等が事故により停止した場合
    4. その他，私が本アプリの提供が困難と判断した場合
  2. 私は，本アプリの提供の停止または中断により，ユーザーまたは第三者が被ったいかなる不利益または損害についても，一切の責任を負わないものとします。

第5条（アンインストール）

ユーザーは，いつでも自分の意思で本アプリをアンインストールできます。

第6条（保証の否認および免責事項）

  1. 私は，本アプリに事実上または法律上の瑕疵（安全性，信頼性，正確性，完全性，有効性，特定の目的への適合性，セキュリティなどに関する欠陥，エラーやバグ，権利侵害などを含みます。）がないことを明示的にも黙示的にも保証しておりません。
  2. 私は，本アプリに起因してユーザーに生じたあらゆる損害について、当社の故意又は重過失による場合を除き、一切の責任を負いません。
  3. 私は，本アプリに関して，ユーザーと他のユーザーまたは第三者との間において生じた取引，連絡または紛争等について一切責任を負いません。
  4. 私は，本アプリが世界中の全ての情報端末機種に対応し、正常に動作することを保証いたしません。
  5. 私は，本アプリがダウンロードされた情報端末のOSやアプリケーションがバージョンアップ等された場合の、正常に動作することを保証いたしません。
  6. 私は，本アプリがアプリストア等の運用方針や規約等の変更により、正常に動作することを保証いたしません。
  7. 私は、第6条の第1項から第6項に関わる全ての不具合について、私の責任と負担で解消することを保証いたしません。

第7条（アプリ内容の変更等）

私は，ユーザーへの事前の告知をもって、本アプリの内容を変更、追加または廃止することがあり、ユーザーはこれを承諾するものとします。

第8条（利用規約の変更）

  1. 私は以下の場合には、ユーザーの個別の同意を要せず、本規約を変更することができるものとします。
    1. 本規約の変更がユーザーの一般の利益に適合するとき。
    2. 本規約の変更が本アプリ利用契約の目的に反せず、かつ、変更の必要性、変更後の内容の相当性その他の変更に係る事情に照らして合理的なものであるとき。
  2. 私はユーザーに対し、前項による本規約の変更にあたり、事前に、本規約を変更する旨及び変更後の本規約の内容並びにその効力発生時期を通知します。

第9条（個人情報の取扱い）

私は，本アプリの利用によって取得する個人情報については，私が制作したアプリ毎に定めた「プライバシーポリシー」に従い適切に取り扱うものとします。

第10条（通知または連絡）

ユーザーと私との間の通知または連絡は，私のSNS（ソーシャルネットワーキングサービス）アカウントによって行うものとします。

第11条（準拠法・裁判管轄）

  1. 本規約の成立、効力、解釈や履行にあたっては，日本法を準拠法とします。
  2. 本規約が日本語とその他の言語で作成され、言語間での矛盾や相違が生じた場合は、全ての点において日本語で作成された本規約を優先します。
  3. 本アプリに関して紛争が生じた場合には，私の自宅所在地を管轄する裁判所を専属的合意管轄とします。

第12条（著作権・権利）

  1. 本アプリにおいて、私が作成したものに関しての著作権・権利は私に帰属します。
  2. 私が有する著作権や権利は第三者に移転することはありません。

【Simple Color Match-3】Terms of Use English Version

These terms of use (hereinafter referred to as "these Terms") specify the terms and conditions for the use of the game application (hereinafter referred to as the "App") provided by Bishatora (hereinafter referred to as "me"). Users (hereinafter referred to as "Users") who play the App shall use this service in accordance with these Terms.

Article 1 (Applicability)

These Terms shall apply to all matters relating to the use of the App between the User and me.

When the User downloads the App onto their information terminal and starts using it, it shall be deemed that the User has agreed to these Terms.

I may establish various rules (hereinafter referred to as "Individual Provisions"), including these Terms, and rules for using the App. Regardless of their names, these Individual Provisions shall constitute a part of these Terms.

In case the provisions of these Terms conflict with those of the Individual Provisions, the provisions of the Individual Provisions shall take precedence, unless otherwise specified in the Individual Provisions.

Article 2 (Advertisements)

Advertisements (Google AdMob) may be displayed.

Article 3 (Prohibited Actions)

Users must not engage in the following actions when using the App:

  • Actions that violate laws or public order and morals.
  • Actions related to criminal activities.
  • Actions that infringe upon copyrights, trademark rights, and other intellectual property rights contained in the App's content, etc.
  • Actions that disrupt or hinder the functions of my servers, other users, or third-party servers or networks.
  • Commercial use of information obtained through the App.
  • Actions that may hinder the operation of my App.
  • Unauthorized access or attempted unauthorized access.
  • Collecting or storing personal information of other users.
  • Using the App for fraudulent purposes.
  • Acts that directly or indirectly benefit anti-social forces in connection with my App.
  • Other actions that I deem inappropriate.

Article 4 (Suspension of App Provision, etc.)

I may suspend or interrupt the provision of all or part of the App without prior notice to the User if any of the following reasons apply:

  • When updating the App.
  • When the provision of the App becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
  • When computers or communication lines are stopped due to accidents.
  • When I determine that the provision of the App has become difficult for other reasons.

I shall not be liable for any disadvantages or damages suffered by the User or third parties due to the suspension or interruption of the provision of the App, except in cases of intentional misconduct or gross negligence on our part.

Article 5 (Uninstallation)

Users can uninstall the App at any time at their own discretion.

Article 6 (Disclaimer)

I do not explicitly or implicitly guarantee the absence of defects (such as safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, etc.) in the App.

I shall not be liable for any damages incurred by the User due to the App, except in cases of intentional misconduct or gross negligence on our part.

I shall not be liable for transactions, communications, disputes, etc. between the User and other users or third parties regarding the App.

I do not guarantee that the App is compatible with all information terminal models worldwide and operates normally.

I do not guarantee that the App will function normally when the OS or applications of the downloaded information terminal are upgraded.

I do not guarantee that the App will function normally due to changes in operational policies or terms and conditions of app stores, etc.

I do not guarantee the resolution of all issues related to Sections 1 to 6 of Article 6 at my own responsibility and expense.

Article 7 (Changes to App Content, etc.)

I may change, add, or abolish the content of the App with prior notice to the User, and the User shall consent to this.

Article 8 (Changes to the Terms of Use)

I may change these Terms without requiring individual consent from the User in the following cases:

  • When the changes to these Terms are in line with the general interests of the User.
  • When the changes to these Terms are not contrary to the purpose of the App usage agreement and are reasonable considering the necessity of the changes, the substantiality of the changes after the changes, and other circumstances related to the changes.

I shall notify the User in advance of the changes to these Terms, the content of the revised Terms, and the effective date of the changes, regarding changes to these Terms as mentioned in the preceding paragraph.

Article 9 (Handling of Personal Information)

I shall handle the personal information acquired through the use of the App appropriately in accordance with the "Privacy Policy" established for each app created by me.

Article 10 (Notifications or Communications)

Notifications or communications between the User and me shall be conducted through my SNS (Social Networking Service) account.

Article 11 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law in terms of their establishment, effectiveness, interpretation, and performance.

These Terms are created in both Japanese and other languages, and in case of contradictions or differences between languages, the Terms created in Japanese shall prevail in all aspects.

In the event of a dispute arising from the App, the exclusive jurisdiction shall be the court having jurisdiction over my place of residence.

Article 12 (Copyrights and Rights)

Copyrights and rights related to what I have created in the App belong to me.

Copyrights and rights held by me shall not be transferred to third parties.
